“Democrats Changed the Laws Established by State Legislatures” Trump Lawyer Tweeted, Remember North Carolina

On Sunday a member of the legal team of President Donald J. Trump posted a statement that may be a hint at the legal claims and case they are building in protest of the final vote tabulation of the 2020 Presidential election.

“This is all about election official fraud. They changed the rules against the laws established by the state legislatures. That is illegal and unconstitutional,” Attorney Jenna Ellis wrote.

Reuters wrote late in September about an uprising in North Carolina over the adoption of election laws by the State Board of Elections, which bypassed the North Carolina State Legislature.

“The two Republicans on the state elections board in battleground state North Carolina resigned late on Wednesday, saying they were misled about plans over how to handle absentee ballots in the November presidential election.

Republicans Ken Raymond and David Black stepped down from the five-member State Board of Elections after the group proposed letting voters correct errors without having to fill out an entirely new absentee ballot, according to a statement with their letters of resignation attached.

The election officials had also struck a tentative agreement on Tuesday to count any absentee ballots that arrive up to nine days after the Nov. 3 election, so long as they are postmarked by Election Day.

The board said in its statement that members had reached unanimous agreement after a full briefing from lawyers.

Arcane voting rules have become the subject of partisan legal battles in 2020 as the coronavirus, which has hit the United States particularly hard, put more focus on procedures for early voting and mail-in ballots.

Republicans have fought some efforts by Democrats and advocacy groups to ease access to the ballot box, citing the potential for fraud, logistical issues and concerns about how it would affect their election chances.

The Republican North Carolina elections board members said they were misled about the implications of the state’s latest decision by civil servants before they signed off on the change, a compromise intended to settle a lawsuit filed by the North Carolina Alliance for Retired Americans, a union-affiliated advocacy group.

“It is impossible to have true bipartisanship when both sides of the political aisle do not have the important and vital information needed to make the right decisions,” Raymond said in his letter.

The state’s Republican Party said the proposed changes were an “unconstitutional attempt to go around the democratic process” that could weaken protections against fraud.

Democrats, in response, railed against Republicans for what they said was a tirade against voting rights. “With 40 days until the election, they have resorted to lying and sowing distrust in our electoral process, all to cling to power,” said Darren Jackson, the state House’s Democratic leader.

North Carolina is a key battleground in the upcoming election, with competitive presidential, congressional and gubernatorial races this year.

I covered the story from North Carolina’s top Republican State Senator on the involvement of Perkins Coie partner Marc Elias who had alleged “secret Meeting” with the State Board of Elections to go around the North Carolina Legislature, which is Republican, to change voter laws:

Top Republican North Carolina State Senator, Phil Berger wrote on Medium his point of view about the collusion that caused the Lt. Governor, Dan Forest, to reach out to US Attorney Bill Barr las week, and ask for an investigation into possible collusion between numerous high ranking Democrats, a Democrat-led Board of Elections and groups of Democrat activists who were using the State judicial system to push for changes in the election laws, frustrating people since the state has already started voting in 2020 Presidential election.

“President Donald Trump’s administration should launch an investigation into a proposed change in North Carolina’s vote-by-mail rules,” Lt. Governor Dan Forest said last week.

Berger echoed Forest, the following is the full text of his letter including his reccomendations for keeping election integrity:

“Meeting minutes from the Sept. 15 closed session of the State Board of Elections reveal a bombshell. The collusive settlement “negotiated” between the Democratic attorneys with the Board of Elections, the N.C. Department of Justice and national Democrats went way beyond the bounds of what the state Board of Elections had originally authorized.

At the very beginning of the meeting, Democratic attorneys falsely told Republican Board members that “privilege” forbade them from speaking to anybody about the collusive settlement. This apparent effort to muzzle the Republican members further supports the fact that Democrats went to great lengths to conceal their secret negotiations with Marc Elias.

Marc Elias is a lawyer behind much of the country’s confusing expansion of changes in voter laws. I wrote about his tactics and techniques in lawsuits here:

Trump’s legal team member, Jenna Ellis is right, as far as North Carolina goes, there is already a public history of Democrats going around the NC State Legislature to change elections and two people who quit their jobs in protest.

Elias brags openly about his lawsuits, believing himself to be a hero:

Using the cover that Democrats needed expansion of Mail in Ballots because of the Corona Virus, Elias has declared himself a human rights hero- who “helped” disenfranchised Democrats.

74 expansions of mail-in voting, that may have gone around the people’s representatives and made this election an absolute mess.
